Welcome to Menthera. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Menthera. We reserve the right to modify these Terms at any time, and your continued use of the service after such modifications constitutes acceptance of the updated Terms.

2. Service Description

Menthera provides AI-powered mental wellness companions designed to support your emotional well-being through:

• Text and voice-based conversations with AI companions
• Personalized wellness insights and recommendations
• Mood tracking and progress monitoring
• Guided meditation and mindfulness exercises
• Evidence-based therapeutic techniques

Important: Menthera is NOT a substitute for professional medical advice, diagnosis, or treatment. Our AI companions are designed to provide support and guidance, but they are not licensed therapists or medical professionals.

3. Eligibility

To use Menthera, you must:

• Be at least 13 years of age (users under 18 require parental consent)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

4. User Accounts

4.1 Account Creation

You must create an account to access our services. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may delete your account at any time through the app settings.

5. Subscription and Payment

5.1 Free Trial

We may offer a free trial period for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically enrolled in a paid subscription.

5.2 Subscription Plans

We offer various subscription plans with different features and pricing. Subscription fees are:

• Charged in advance on a recurring basis (monthly or annually)
• Non-refundable except as required by law
• Subject to change with 30 days' notice
• Automatically renewed unless you cancel before the renewal date

5.3 Payment Methods

You authorize us to charge your selected payment method for all fees. You are responsible for:

• Any fees charged by your payment provider

5.4 Cancellation

You may cancel your subscription at any time through the app settings or your App Store account. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

You agree to use Menthera only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the service
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Use the service for commercial purposes without authorization
• Reverse engineer or attempt to extract source code
• Use automated systems to access the service

• User interface and design elements
• Trademarks and service marks

Are owned by Menthera or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.

9. User Content

You retain ownership of any content you create or submit through Menthera. By using our services, you grant us a limited license to:

• Process and analyze your conversations to provide personalized responses
• Use anonymized and aggregated data to improve our services
• Store your content as necessary to deliver our services

We will never share your personal conversations publicly or use them for marketing purposes without your explicit consent.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. By using Menthera, you consent to our privacy practices as described in the Privacy Policy.

11. Disclaimers and Limitations of Liability

11.1 Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

11.2 AI Limitations

Our AI companions are advanced but not perfect. We do not guarantee:

• Accuracy or completeness of AI responses
• Achievement of specific mental health outcomes
• Compatibility with all devices or operating systems
• Freedom from errors, bugs, or security vulnerabilities

11.3 Limitation of Liability

To the maximum extent permitted by law, Menthera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the service.

12. Indemnification

You agree to indemnify, defend, and hold harmless Menthera and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another person or entity
